Case Studies

These examples represent a small sample of the many cases in which Intrabank has helped clients by supplying experts with the specific knowledge and experience needed to reach the optimum result.

Inevitably, for reasons of brevity and confidentiality, they can only give a flavour of the issues involved.

Banking: Corporate

An expert's opinion was needed to establish what constitutes the reasonable notice that a bank should give a corporate client to arrange alternative finance. Intrabank's expert showed that the bank had not given sufficient notice and the client won its case.

Banking: International

An off-shore company in dispute required an expert on the rules of the New York Stock Exchange between two specific dates. Intrabank supplied an expert who through his detailed knowledge of the rules and practices was able to assist the advocates in proving malpractice.

Banking: Personal

A client was in dispute with his bank over the level of charges. Intrabank's expert helped the client establish that he had been grossly and unreasonably overcharged, thereby winning his case.

Banking: Treasury

The liquidators of a bank needed assistance in exploring a black hole in the treasury operations. Intrabank supplied an expert treasury controller who identified the irregularities, leading ultimately to the conviction of the senior official concerned.

Banking: Treating Customers Fairly

A specialist house builder enjoyed a good banking relationship with his bank for many years until a new Business Manager was appointed. The relationship soured very quickly and the company re-banked following a period of intense pressure from the bank, including unprofessional behaviour from the new manager to persuade the company to dispose of assets and reduce borrowings. Following the issue of our Intrabank Expert Witness Report, a large negotiated settlement was agreed by a Bank prior to Court.

Over a six month period, an electrician was instructed by his bank manager to withdraw a total of £70k from various personal credit cards to inject into his business – on the basis that the bank manager had agreed to formalize a substantial Overdraft Limit on their Limited Company bank account. This never materialized, and the company was forced into liquidation by the bank, leaving the electrician with a substantial amount of personal debt to service and repay after his business had gone into liquidation. After waiting in excess of twelve months for the unsatisfactory outcome of a complaint to the Financial Ombudsman, a solicitor commissioned an Intrabank Expert Witness Report to secure an offer from the bank.

Finance: Property Valuation

Intrabank's property valuation expert assisted a Building Society to successfully sue for negligence a surveyor who had overvalued a private residence in order to facilitate a mortgage.

Finance: Money Laundering

The Crown Prosecution Service needed an expert in international money laundering. Intrabank's expert showed how money transaction systems worked and helped the prosecution succeed.

Insurance: Breach of Contract

A major insurance company was being sued for breach of contract by a former direct sales branch manager of a company that it had taken over. Through identifying the weaknesses in the former employee’s argument and relating what happened to the regulation and practices of the period, Intrabank helped the company successfully defend its position against the former employee.

Insurance: Human Resources

An employee was told verbally by his employers that as an executive on a high salary he would be covered by their ill health insurance arrangements. The company failed to include the employee on the policy and rejected a claim. A human resources specialist supplied by Intrabank helped the client to achieve settlement.

Insurance: Non-disclosure

A widow claimed against an insurance company for failing to pay out on a life insurance policy. Intrabank supplied the company with an expert who though his detailed knowledge of underwriting procedures and legislation was able to demonstrate that the deceased had been guilty of material non-disclosure, thereby invalidating the claim.

Investments: Mis-selling

A major independent financial adviser recommended investment contracts that failed to take into account the client’s tax position whereby he had substantial realised capital losses. Intrabank helped the client quantify the damage and prove mis-selling resulting in substantial compensation.

Investment: Trustee negligence

Solicitors acting on behalf of a beneficiary needed an expert in Trustee Investments. Intrabank's expert was key to establishing that the Trustees

had been negligent in their handling of the funds and the beneficiary won an undisclosed sum in compensation.

Pensions: Advice

Intrabank was approached regarding a case where an agent did not advise a client of problems in his pension arrangements. Intrabank's pensions expert analysed the situation and identified additional ground for complaint, leading to substantial compensation.
